This contribution examines the practical legal implications of the EU Cyber Resilience Act (CRA) for Free and Open Source Software (FOSS). It focuses on the regulatory challenges faced by developers and open-source communities, including the distinction between commercial and non-commercial activities, liability and compliance obligations, and the potential impact of the CRA on the development and distribution of FOSS. The contribution combines a legal analysis of the CRA with practical considerations and examples, highlighting key issues that developers, organisations and other stakeholders should be aware of when working with open-source software.

Pavel Loutocký is an assistant professor at the Institute of Law and Technology, Faculty of Law, Masaryk University. He focuses in his research, teaching, and publishing activities on the regulatory aspects of electronic identification and trust services, document security, digital identity management, cybersecurity, liability and risk management of online platforms, and online consumer protection; he also focuses on online dispute resolution (including automation). He participates in national and international projects and lectures on these topics. Since 2012, he has served as an observer for selected UNCITRAL working groups and teaches as an adjunct at Georg August University of Göttingen, Danube University Krems, and the University of Pécs. He is a fellow of the NCTDR, ISLC (University of Milan) and is listed as an ENISA expert.
